DMCA Policy

TourGarage respects the intellectual property rights of others. If you believe that content on TourGarage (tourgarage.com) infringes your copyright, please submit a takedown notice as described below in accordance with the Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512.

How to submit a takedown notice

Your written notice must include all of the following elements:

  1. Identification of the copyrighted work — A description of the work you claim has been infringed (e.g., "the photograph titled X, published at [your URL]").
  2. Identification of the infringing material — The specific URL(s) on TourGarage where the allegedly infringing content appears. Be as specific as possible.
  3. Your contact information — Your full name, postal address, telephone number, and email address.
  4. Good faith statement — A statement that you have a good faith belief that the use of the material in the manner complained of is not authorised by the copyright owner, its agent, or the law.
  5. Accuracy statement — A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or are authorised to act on behalf of the copyright owner.
  6. Signature — A physical or electronic signature of the copyright owner or a person authorised to act on their behalf.

Where to send your notice

Submit DMCA notices through our Contact page with the subject line DMCA Takedown Notice. Do not send DMCA notices to editorial or social media addresses — notices sent elsewhere may not receive a timely response.

Our response process

Upon receipt of a complete and valid DMCA notice, TourGarage will:

  1. Acknowledge receipt within 2 business days.
  2. Investigate the claim and, where the notice is valid, remove or disable access to the identified content promptly.
  3. Where appropriate, notify the contributor of the affected content that a takedown notice has been received.
  4. Inform you of the outcome of our review.

Counter-notices

If you are a contributor whose content has been removed as a result of a DMCA notice and you believe the removal was a mistake or the result of misidentification, you may submit a counter-notice through our Contact page with the subject line DMCA Counter-Notice. A counter-notice must include the information required under 17 U.S.C. § 512(g)(3).

Repeat infringer policy

TourGarage will terminate access for contributors who are found to be repeat infringers in appropriate circumstances.

Misrepresentation

Please be aware that under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material is infringing, or that material was removed by mistake, may be subject to liability. Ensure that you are the copyright owner or are authorised to act before submitting a notice.
